MUDSLIDE 500 - EVENT PARTICIPANT AGREEMENT, WAIVER, AND RELEASE FROM LIABILITY

I, the undersigned participant, in consideration for being permitted to participate in the Mudslide 500 event (the "Event"), acknowledge and agree to the following:

1. Assumption of Risk: I acknowledge that the Event involves inherent risks, including but not limited to, the risks of injury or death from operating a boat, consuming alcohol, and other risks associated with outdoor recreational activities. I willingly and voluntarily assume all risks and hazards associated with participating in the Event, whether known or unknown, foreseeable or unforeseeable.
2. Waiver and Release: I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby waive, release, discharge, and covenant not to sue Ian Crowley, his employees, agents, representatives, volunteers, sponsors, or any other individuals or entities associated with the Event (collectively, the "Released Parties"), from any and all claims, liabilities, damages, actions, causes of action, costs, or expenses, including attorney fees, wrongful death, injury, loss, or damage of property, whether arising from the negligence of any or all of the Released Parties or otherwise, to the fullest extent permitted by law.
3. Indemnification: I agree to indemnify and hold harmless the Released Parties from and against any and all losses, liabilities, damages, costs or expenses (including but not limited to reasonable attorneys' fees and other litigation costs and expenses) incurred by any of the Released Parties as a result of any claims or suits that I (or anyone claiming by, under or through me) may bring against any of the Released Parties to recover any losses, liabilities, costs, damages, or expenses which arise during or result from my participation in the Event, regardless of whether or not caused in whole or part by the negligence or other fault of any of the Released Parties.
4. Acknowledgement of Rules and Safety Regulations: I agree to abide by all rules and safety regulations established by the Event organizers, which have been made available to me prior to the Event. I understand that my failure to adhere to these rules and regulations can result in my immediate removal from the Event without refund.
5. Medical Treatment: I authorize Event staff to provide me assistance, transportation, and medical services as they see fit in case of an injury or medical conditions that may arise during my participation.
6. Severability: If any term or provision of this Agreement or the application thereof to any person or circumstance shall, to any extent, be invalid or unenforceable, the remainder of this Agreement, or the application of such term or provision to persons or circumstances other than those as to which it is held invalid or unenforceable, shall not be affected thereby, and each term and provision of this Agreement shall be valid and be enforced to the fullest extent permitted by law.

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING MY RIGHT TO SUE. I ACKNOWLEDGE THAT I AM SIGNING THIS AGREEMENT FREELY AND VOLUNTARILY, AND INTEND MY CHECKING OF THE "I AGREE TO THE TERMS AND CONDITIONS" BOX TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
